 The NSD Association may, but shall not be obligated to, maintain or support certain activities within the NSD designated to make the NSD safer than they otherwise might be. Neither the NSD Association, its Board of Directors, committees or developer shall in any way be considered insurers or guarantors of security within the properties, and neither the NSD Association, its Board of Directors, committees or developer shall be held liable for any loss or damage by reason of failure to provide adequate security or ineffectiveness of security measures undertaken. All owners and occupants of any unit, lot, parcel or vacant parcel and tenants, lessees, guests, invitees and licensees of any owner, as applicable, acknowledge that the NSD Association and its Board of Directors, committees and developer do not represent or warrant that any fire protection system, burglar alarm system or other security system designated by or installed according to guidelines established by the NSD Association, its Board of Directors, committees or developer may not be compromised or circumvented, that any fire protection or burglar alarm systems or other security systems whether manned or unmanned will prevent loss by fire, smoke, burglary, theft, hold-up, or otherwise, nor that fire protection or burglar alarm systems or other security systems whether manned or unmanned will in all cases provide the detection or protection for which the system is designed or intended. Each owner, lessee and occupant of any unit, lot, parcel or vacant parcel and each tenant, guest , invitee and licensee of an owner, as applicable, acknowledges and understands that the NSD Association, its Board of Directors, committees and developer are not insurers and that each owner, lessee and occupant of any unit, lot, parcel, and each tenant, guest, invitee and licensee of any owner assumes all risks for loss or damage to person, to units, lots, parcels and vacant parcels and to the contents thereof and further acknowledges that the NSD Association, its Board of Directors, committees and developer have made no representations or warranties nor has any owner, lessee, occupant, tenant, guest, invitee or licensee relied upon any representations or warranties, expressed or implied, including any warranty of merchantability or fitness for any particular purpose, relative to any fire and/or burglar alarm systems or other security systems whether manned or unmanned recommended or installed or any security measures taken within the properties.
