HARBOUR ISLAND SOUTH NEIGHBORHOOD ASSOCIATION RULES AND REGULATIONS

Outlined below is a set of Rules and Regulations, which have been adopted by the Board of Directors of the South Neighborhood Association, Inc. It should be noted that the scope of these rules extends only to the common areas governed by this Board and does not apply to individual neighborhoods. Each neighborhood has the responsibility to maintain and enforce its own rules with the exception of parking violations.
1. ACCESS CONTROL
1A. Bar codes will only be issued to vehicles owned and registered to an SNA resident and registered with the SNA office.
1B. Residents without bar codes will be required to enter through the Visitor lane and show photo ID or state PIN number and a guest pass will be issued. There will be no exceptions.
1C. The authorized Guests will be required to show photo ID.
1D. A guest pass will be issued to the vehicle upon confirmation by the resident that access is permitted. If confirmation cannot be obtained, the guest will be denied access.
1E. The guest pass must be displayed on the dashboard of the vehicle.
1F. Pedestrian and bicycle traffic are required to show photo ID.
2. CONTRACTORS
2A. The access control hours for contractors, except for emergencies, are as follows:
Monday – Friday 7:00 a.m.– 6:00 p.m.
Saturdays 8:00 a.m. – 2:00 p.m.
Sundays No activity permitted
No activity permitted on the following holidays:
New Year’s Day
Gasparilla Celebration
Memorial Day
July 4
Labor Day
Thanksgiving Day
Christmas Day
2B. All contractors are required to use the East gate for access and egress.
3. DELIVERIES
3A. The access control hours for deliveries, except for emergencies, are as follows:
Monday – Friday 7:00 a.m. – 6:00 p.m.
Saturdays 8:00 a.m. – 2:00 p.m.
Sundays No activity permitted
No activity is permitted on the following holidays:
New Year’s Day
Gasparilla Celebration
Memorial Day
July 4
Labor Day
Thanksgiving Day
Christmas Day
3B. U.P.S., Federal Express, DHL and the U.S. Postal Service are permitted access 7 days a week from 7 a.m. to 8 p.m. Deliveries after 8 p.m. and on Sundays and holidays will be permitted after registering with the gate attendant and receiving a guest pass.
4. FINES
4A. Per Article 15 of the SNA Bylaws, the Board of Directors has the right to suspend or place conditions on a violator’s right to use SNA Common Property including revocation of bar codes (except for the portion which is necessary as a means of ingress and egress) and to fine a violator. These actions can only occur after the alleged violator has been given an opportunity for a hearing and upon an affirmative vote of the majority of all members of the Board.
4A.1. All complaints submitted to the Board of Directors must be in writing and contain a written statement which clearly states the charge(s) and the specific provision of the Governing Documents which the violator is alleged to have violated. Complaints may be submitted by any Owner, Officer or presiding Director.
4A.2. The Board shall refer the matter to an Appeals Board. No member of the Appeals Board shall be an officer, director or employee of the Association or be related to same.
4A.3. The Appeals Board shall schedule a hearing. All parties must be notified at least 14 days prior to a hearing.
4A.4. The Appeals Board shall prepare written findings of fact and recommendations for Board consideration. The Board may impose disciplinary action and fines under the Governing Documents and in accordance with the findings and recommendation of the Appeals Board. The Board of Directors cannot impose more stringent disciplinary action than recommended by the Appeals Board.
4A.5. The Board may levy reasonable fines, not to exceed $100 per violation, per day, up to a maximum of $1,000.00.
5. LITTER/TRASH
5A. No litter, trash, rubbish, debris, objects or materials of any kind shall be placed or permitted to accumulate upon any common property.
6. MEDIA
6A. Only media visitors who have been invited by a resident will be allowed access and issued a pass. They must be escorted to the residence by the Patrol officer on duty.
7. MOVE IN/OUT
7.A. The access control hours for move in/out are as follows:
Monday – Friday 7:00 a.m.– 6:00 p.m.
Saturdays 8:00 a.m. – 2:00 p.m.
Sundays No activity is permitted
No activity permitted on the following holidays:

7B. If an owner or tenant is moving in or out on a Saturday, the move must commence prior to 10:30 a.m. If the move is occurring on a weekday, the move must commence prior to 1:30 p.m.
8. NOISE AND NUISANCES
8A. No disturbing activity, such as loud music, is permitted between 10:00 p.m. and 6:00 a.m., Sunday through Thursday, and between 11:00 p.m. and 6:00 a.m. on Friday and Saturday.
8B. In addition, the following acts are declared to be loud, disturbing and unnecessary noises and/or nuisances:
8B.1. Horns and warning device. The sounding of any horn or signal device of any automobile, motorcycle, or any other vehicle, whether in motion or not, except as a necessary danger signal is prohibited.
8A.2. Noisy vehicles. The use of any automobile, motorcycle or other vehicle so loud or out of repair or operated as to create excessive noise, avoidable and unnecessary grating, grinding, and rattling noise is prohibited.
8A.3. Amplified sound. Operating any device which electronically or disturb the quiet, comfort and repose of a reasonable person in any dwelling between the hours of 10:00 p.m. and 8:00 a.m. is prohibited.
Problems of an immediate nature should be reported to the City of Tampa Police Department by calling “911”. Continuing problems of this nature should be reported in writing to the individual community’s property manager.
9. PARKING
9A. Parking rules on common property roadways will be strictly enforced and violators will be towed.
9B. Parking on Harbour Passage Drive and Harbour Bay Drive will be limited to 72 hours. Violators will be towed.
9C. SNA will ticket those vehicles with a bar code that are parked in a space designated “guest parking” in the communities participating in the Ticketing/ Towing policy adopted by the Board.
9D. SNA will ticket those vehicles that are parked in an area which is not designated as a parking space in the communities.
9E. Moving vans are not permitted to park on SNA roadways without Board approval. This includes self moving vehicles, e.g., U Haul trucks and trailers.
9F. Trailers, campers, motor homes, recreational vehicles, boats or jet skis are not permitted to park on SNA roadways at any time.
9G. Neither construction trailers nor Portable On Demand Storage (PODS) are permitted to remain on SNA property after 6 p.m. on weekdays or after 2 p.m. on Saturdays without Board approval.
10. PARTIES OR LARGE GATHERINGS
10A. Gatherings of a large number of people can block access for emergency vehicles, result in damage to SNA common property, create a higher security workload and clean-up costs. In an effort to support SNA residents in the most equitable way, the following guidelines for gatherings have been established:
10A.1. For any event with more than 50 invited guests, an alphabetized guest list shall be provided to the SNA office 48 hours prior to the event.
10A.2.For any event with more than 100 invited guests, the homeowner or their designated event coordinator will be required to contact the SNA office at least five (5) days prior to the event to coordinate:
- Plan for offsite parking and/or valet service
- Plan for access control and validation of invitees (such as designation of an assigned entry point or wristbands)
- Coordinate additional crowd control support.
10B. The Tampa Police Department will be brought in for situations involving public drunkenness or other inappropriate behavior
11. PETS
11A. All resident pets must be registered with the appropriate property management company.
11B. All persons are required to have any pets on a leash, which is attached to a responsible person, when on common property.
11C. All persons shall immediately remove their animal's excrement from SNA property and dispose of the waste in containers provided or at their residences.
11D. Pet owners are responsible for insuring their animals do not unreasonably annoy humans, endanger the life or health of other animals or persons, or substantially interfere with the rights of other residents. Prohibited behavior shall include, but not be limited to:
· Running loose
· Damaging the property of residents other than the owner's
· Molesting or intimidating residents or guests
· Howling, barking, whining or other disturbing noises
· Attacking fowls, birds or other domestic animals
12. PLAYGROUND
12A. Hours of operation for the playground are 8:00 a.m. until sunset daily.
12B. Children under 13 years of age must be supervised by an adult.
12C. Users of the playground do so at their own risk.
12D. Children must wear shoes while using the playground.
12E. No pets are permitted within the playground
12F. No signs are permitted within the playground area or on its perimeter.
12G. Smoking is not permitted.
13. PROPERTY DAMAGE
13A. The homeowner will be held responsible for any damage to SNA common property, equipment or other common elements caused by themselves, a tenant or guest including but not limited to recovery of repair costs.
14. REALTORS
14A. All realtors conducting business south of the resident gates must be authorized by the seller. Realtor Authorization and Information forms are available at the SNA office. Forms must be completed and turned into the SNA office before the realtor can show a residence.
14B. Property may be shown to qualified buyers by appointment only.
14C. All potential buyers must be escorted by and be in the company of a licensed realtor.
14D. All sales activity involving licensed realtors other than the listing realtor must be coordinated by the listing realtor.
14E. All realtors must provide the gate attendant with a contact phone number.
14F. All realtors must show photo I.D and a business card before entry will be permitted. Those persons unable to properly identify themselves will be turned away. A list of the names of those persons in the vehicle must also be provided to the gate attendant.
14G. Realtors are not allowed to post signs of any kind on Harbour Island.
14H. The gate attendants are not permitted to distribute flyers of any type for real estate agents.
15. REALTOR CARAVANS
15A. Realtor caravans will be permitted on the second and fourth Wednesdays of the month between the hours of 10 a.m. and 1 p.m.
15B. Only licensed real estate agents will be permitted to participate in the Harbour Island caravan.
15C. All participating agents will be required to show appropriate identification, e.g., a business card and photo ID.
15D. The agent must state the purpose of their visit as participating in the realtor caravan. In the event of multiple persons in one vehicle, all must show appropriate identification. A visitor pass will be issued and displayed on the dashboard. If anyone in the vehicle is not a licensed real estate agent, the party will not be permitted access.
15E. Realtors are not allowed to post signs of any kind on Harbour Island.
15F. The gate attendants are not permitted to distribute flyers of any type for real estate agents.
16. SIGNS
16A. No sign, notice or advertising may be placed on SNA property. The SNA is permitted to place a sign for directional, informational, safety and/or notice purposes. In addition signs approved by the Architectural Review Committee (ARC) shall be permitted on SNA property.
17. SOLICITATION
17A. Solicitation, with the exception of SNA related business, on the property for any cause, charity or for any other purpose is prohibited.
18. SPEED LIMIT
18A. A speed limit of 20 mph must be observed at all times. Residents, guests and/or contractors in violation of the speed limit will receive a $50.00 traffic citation fee.
19. SUPERVISION OF CHILDREN
19A. Supervision must be exercised when children are playing on SNA property.
20. SUPERVISION OF EMPLOYEES
20A. No homeowner, tenant or guest is permitted to direct, supervise or in any manner attempt to assert any direct of control over the employees or contractors of the SNA.
21. TRAFFIC
21A. All residents and/or guests shall come to a full stop at STOP signs.
21B. All residents and/or guests are required to comply with the vehicular traffic signs which include speed, stop, one way and yield.
21C. Residents, guests and/or contractors violating traffic rules will receive a $50.00 traffic citation fee.
22. VEHICLES
22A. All homeowners and tenants are required to register all vehicles at the SNA office.
22B. The operation of motorized scooters, skateboards and Segways on all SNA property shall be prohibited at all times. The operation of non-motorized scooters and skateboards on the roadways only is allowed during daylight hours only (dawn to dusk).
22C. No major repairs (except in an emergency) or major restoration of any motor vehicle, boat, trailer or other vehicle is permitted.
23. WATER WALK
23A. Engineering capacities have been determined for the safe use of the water walk. Maximum weight restrictions have been posted by the Association and shall be adhered to.
23B. Golf carts and other motorized vehicles (motorbikes, motorcycles, motorized skateboards and scooters), other than security or property management vehicles, are not allowed on the waterwalk.
23C. All pets are required to be on a leash which is attached to a responsible person when on the water walk.
23D. Means for removal of animal fecal waste must be carried by the responsible person at all times while walking pets around the water walk.
23E. No commercial advertising is permitted. (except for manufacturers logos on boats and boating equipment).
23F. Water walk shall be kept clear of obstructions. Bicycles, boat equipment and other materials shall not be stored on the water walk.
